Drafting “Single” and “Separate” Trusts in InterActive Legal

All InterActive Legal Wills and Trusts allow the drafter to incorporate trusts for individuals with various terms.  When planning for descendants or nieces and nephews, the drafter selects between "Separate Trusts" and a "Single Trust," but those labels may not be self-explanatory.  In this webinar, we'll first discuss what we mean by the terms Separate Trusts and Single Trusts, how they are designed, and how they differ, with the objective of making it easier to decide which is appropriate in a specific drafting situation.  We will then go through the drafting options for each type of trust, including selections for when a trust terminates, powers of appointment, SNT options, conduit/accumulation trust provisions, and more.

Revenue Ruling 2023-2: What it Means and What You Might Do

Do assets in an irrevocable grantor trust that are not included in the settlor’s estate qualify for an income tax basis step up on the death of the grantor? In 2002 Jonathan Blattmachr and Professor Mitchell Gans authored an article analyzing this matter. This issue seems to stir up as many opinions and strong emotional reactions today as it did when it was first published. After several powerful Senators wrote a letter to Janet Yellin, the IRS issued Revenue Ruling 2023-2 stating that, in the opinion of the Service there is no basis step up for assets in a grantor trust not included in the settlor’s estate. The IRS indicated that Code Section 1014 is inapplicable because there is no estate-tax inclusion and it is not a bequest under state law. While you might have heard strong opinions pro and con on this point, what does the law actually say?

Closely Held Business Buy-out Arrangements Should be Reviewed Immediately in Light of the Recent Connelly Case

Practitioners should inform clients with buy sell redemption agreements about the recent Connelly v. IRS, No. 21-3683 (8th Cir. 2023) that held that corporate owned life insurance had to be included in the value of the company. This recent case requires that buy-sale agreements, buy-out agreements, ownership of life insurance to be used in buyouts must all be reviewed.
