Planning After SECURE: Have We Adjusted?

For estate planners, the SECURE Act, which became effective in 2020, was a true disruptor for the profession. SECURE ushered in significant changes that required estate planners to change the way they think about retirement benefits and how they plan for them. 2022 brought about proposed regulations and SECURE 2.0, both of which resulted in further disruption of this area of the law. Now, nearly four years after SECURE, have estate planners learned to adjust to the new rules when advising clients on retirement benefits? Are estate planning documents adequately addressing the changes in the law relating to see-through trusts and required minimum distributions? Should we be doing more to navigate to this new landscape, following the disruption of SECURE? In this session, we will discuss these topics and offer some ideas for estate planners to consider as they advise clients and prepare new documents, including: The best way to draft a trust that might possibly qualify as an AMBT, whether a separate retirement trust may now be the best solution for some clients, and whether worrying about see-through trust status is still worthwhile in most cases. This presentation will incorporate the post-SECURE rules and the proposed regulations into the discussion but is not a comprehensive discussion of all the new rules. Attendees should have a basic familiarity with SECURE and the proposed regulations in order to get the most out of the discussion.
