Letha Sgritta McDowell is licensed to practice in both North Carolina and Virginia and has been an elder law and special needs planning attorney for more than 10 Years. Ms. McDowell is a Certified Elder Law Attorney and Board Certified as a specialist in Elder Law by the North Carolina State Bar Board of Legal Specialization and she is accredited to prepare and prosecute claims with the Department of Veterans Affairs.

Ms. McDowell is a member of the Board of Directors for the National Academy of Elder Law Attorneys, a member of the North Carolina Bar Association's Elder Law and Estate Planning Sections, serves as Vice President of the Elder Law Specialization Committee for the North Carolina State Bar, and serves as an active mentor to a number of young attorneys through the North Carolina Chapter of the National Academy of Elder Law Attorneys. Ms. McDowell is a 2001 graduate of Purdue University and a 2004 graduate of the University of Maine School of Law.

Stephen J. Silverberg is nationally recognized as a leader in the areas of estate planning, estate administration, asset preservation planning and Elder Law. He is a past president of the prestigious National Academy of Elder Law Attorneys (NAELA), and a founding member and past president of the New York State chapter of NAELA.

Silverberg was awarded the credential of NAELA Fellow, the highest honor bestowed by NAELA to "attorneys... whose careers concentrate on elder law, and who have distinguished themselves both by making exceptional contributions to meeting the needs of older Americans and by demonstrating commitment to the Academy." Silverberg is also a founding member of the New York State chapter of NAELA.

He holds the designation of a Certified Elder Law Attorney (CELA), awarded by the National Elder Law Foundation. There are fewer than 400 CELAs throughout the United States.

Post-Election Estate Planning What to Do For Clients In November and December of 2020

The 2020 election demonstrated that the projected Democratic sweep did not occur. Former Vice President Biden won the Presidency, but that is still being challenged. The Republicans have control of the Senate it appears, but two runoff elections in Georgia in January 2021 may provide the Democrats a chance to pick up two additional seats making the Senate evenly split between Democrats and Republicans. What does this all mean to clients that were engaged in planning in anticipation of the Blue Wave that did not happen?

What Should Estate Planners Do Now? An InterActive Legal Post-Election Video Roundtable Event

Election Day 2020 is now behind us. As of this writing, most election results are in, though opinions vary about when we will know the full makeup and distribution of power between the Executive and Legislative branches. Court challenges, recounts, and run-offs all move forward, with the latter not taking place until January. Given that we may not have certainty for weeks (and in some cases months), estate tax planners charged with advising their clients on how to proceed for the balance of the year are in a bit of limbo. Advisors must determine whether to recommend taking action now or wait for more information, and come up with a plan for going forward after all results are finalized.
