Estate planning and asset protection both usually involve giving property away, often in trust, and someone must be named as the trustee.  Some clients – who may not be keen on the idea of transferring property to begin with – may want to maintain control and therefore would like to be the trustee.  Other clients may not have anyone else that they trust to fill that role and therefore would like to serve as trustee themselves.  These scenarios raise the important question of when a client who creates a trust can serve as trustee.  

A trust creator could retain some limited control – perhaps by serving as a Trust Protector or as a trustee with very defined (and limited) powers.  But in many cases, it’s arguably best if the creator of the trust has no control over the trust at all.  

In this webinar, Jonathan Blattmachr and Michael Graham, co-founders of InterActive Legal, will draw from their years of estate planning and tax experience to discuss the reasons behind the general rule that the creator of a trust should not be the trustee, and to consider when we might carve out exceptions to that rule.  We’ll cover the concept of Trust Protectors as well as trustees who serve with limited powers.  The presentation will also examine relevant authority, including a variety of applicable cases.  We will also discuss the important issue of substance over form in the context of trust control – where the way a trust actually operates can be problematic, even though it was set up properly.
