Estate planning and Medicaid planning have common elements, such as creating trusts for asset protection, but they also have unique issues.  

This course is designed for estate planners who are interested in learning more about the basics of Medicaid planning.  Some clients can plan ahead for future Medicaid qualification while others have a more urgent need, and we’ll cover both proactive advance planning and reactive crisis planning.  

Participants will gain an understanding of the Medicaid program, enhancing their ability to support senior clients.

Key Topics Include:

  • Introduction to Medicaid Eligibility: Understand the criteria and process for Medicaid qualification.
  • Advance Planning with Trusts: Irrevocable trusts are often used to plan ahead for Medicaid qualification.  We will introduce various features of these trusts designed to protect families and minimize overall taxation.
  • Crisis Planning, Including Medicaid Compliant Annuities: Learn the definition, requirements, and strategic application of Medicaid Compliant Annuities.
  • Funeral Expense Trusts: Explore how Funeral Expense Trusts can serve as effective planning tools.
  • Case Studies: Examine real-world scenarios that demonstrate how crisis planning tools like Medicaid Compliant Annuities have expedited eligibility for the Long-Term Care Medicaid Program, even when clients are already in nursing homes.

By the end of this course, attorneys will be equipped with the knowledge and tools necessary to navigate the complexities of long-term care planning, ensuring optimal outcomes for their senior clients.
