SUMMARY:InterActive Legal Academy Masterclass Series: "Why Your Client Can’t be Trustee - or Can They?"
DESCRIPTION:The InterActive Legal Academy Masterclass Series is an exclusive new CLE-included program featuring elevated\, fee-based events that deliver advanced insights from the nation’s leading estate planning professionals. \n\n\n\n\n\n\n\n\n\nCLE Credit included: 1.0 General CLE Credit (Approved in CA\, FL\, IL\, NJ\, NY\, and TX; self-submit available in other states)\n\n\n\nCost: $70.00 \n\n\n\n \n\n\n\n\n\n\n\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n\n\n\n	\n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Estate planning and asset protection both usually involve giving property away\, often in trust\, and someone must be named as the trustee.  Some clients – who may not be keen on the idea of transferring property to begin with – may want to maintain control and therefore would like to be the trustee.  Other clients may not have anyone else that they trust to fill that role and therefore would like to serve as trustee themselves.  These scenarios raise the important question of when a client who creates a trust can serve as trustee.   \n A trust creator could retain some limited control – perhaps by serving as a Trust Protector or as a trustee with very defined (and limited) powers.  But in many cases\, it’s arguably best if the creator of the trust has no control over the trust at all.   \n \n \n \n \n \n \n \n \n \n \n \n In this webinar\, Jonathan Blattmachr and Michael Graham\, co-founders of InterActive Legal\, will draw from their years of estate planning and tax experience to discuss the reasons behind the general rule that the creator of a trust should not be the trustee\, and to consider when we might carve out exceptions to that rule.  We’ll cover the concept of Trust Protectors as well as trustees who serve with limited powers.  The presentation will also examine relevant authority\, including a variety of applicable cases.  We will also discuss the important issue of substance over form in the context of trust control – where the way a trust actually operates can be problematic\, even though it was set up properly.  Join us for expert thoughts on a topic relevant to clients of all levels of wealth. \n \n \n \n \n \n \n InterActive Legal is partnering with Beacon Live to offer CLE Credit for this webinar. You will need to create a Beacon Live account (or use your existing account) to register for this event. \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Learn from InterActive Legal’s Founders! \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Jonathan G. SUMMARY:Extension and Increase of Basic Exclusion Amount: Including Impact On “Moderately” Wealthy Clients
DESCRIPTION:Complimentary Webinar: Practice Better: AI\, Planning Numbers\, Defensive Steps and More\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n\n\n\n	\n \n \n \n View Recording\n \n \n \n \n \n \n \n \n \n \n Webinar Description \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n This webinar will provide a discussion of a wide range of current estate planning topics in the post-OBBBA environment:  \n \n \n \n Non grantor trusts can be used to maximize charitable contributions and SALT and other OBBBA benefits. \n Non-grantor SLANTs are an important technique\, but who qualifies as an adverse party?\n Terminating existing trusts for basis step up has become a conversation topic with many clients\, but does it make sense?\n When and how might it be accomplished?\n What are the pros/cons and considerations of terminating a trust?\n \n \n \n \n \n \n \n \n \n \n \n \n Other topics will be touched on as well.  For example\, asset protection – and in particular domestic asset protection trusts (DAPTs) – are important to planning with the new high exemption to ensure access.  Recent cases from Delaware and Colorado will be reviewed.  Many of the decisions about which type of trust to use for which client have changed – such as incomplete vs. completed gift trusts considering the higher exemption and basis step up.  Determining how much access to give a settlor in an irrevocable trust has evolved. This new calculus – hybrid DAPT\, SPAT\, loans\, underlying entities\, tax reimbursement (new CCA) – will be reviewed\, along with how to adapt planning for clients of moderate wealth.  We’ll discuss when it makes more sense to use local trusts and individual trustees\, instead of settling a trust in a different state with an institutional trustee.  We’ll also cover portability\, including the recent Rowland estate – many clients may overlook the portability option due to the newly-high “permanent” exemption\, but most should still file to preserve the deceased spouse’s unused exemption (DSUE). \n \n \n \n \n \n \n \n View Recording\n \n \n \n \n \n \n \n \n \n \n Meet Our Speakers \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Jonathan G. Does that impact DAPT or asset protection planning? \n There is growing discussion of terminating irrevocable trusts to cause appreciated assets to be included in someone’s estate to gain a basis step-up. What issues should be considered and what approaches should be evaluated? \n Every adviser gets inquiries from prospects that would be best not to be accepted as a client. How can AI quickly help you identify those potential bad eggs you want to avoid? How should you implement such a process to avoid issues? \n \n \n \n \n \n \n \n \n \n \n \n Many new clients come with long complex existing irrevocable trusts. How can you efficiently identify issues and planning opportunities in those trusts using AI? For example\, if there are powers of appointment your client holds you want to be able to advise them on the pros/cons of exercising them. \n Finally\, an approach that is not only protective for the practitioner\, but appreciated by most clients\, is to offer several planning options. If those options can be illustrated and explained with numbers\, some clients will understand them better. \n \n \n \n \n \n \n \n View Recording\n \n \n \n \n \n \n \n \n \n \n Meet Our Speakers \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Alan S. SUMMARY:Serving Hispanic Families with Compassionate Estate Planning: Practical Insights for Advisors
DESCRIPTION:Complimentary Webinar: Future of the Estate Planning Profession\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n\n\n\n	\n \n \n \n View Recording\n \n \n \n \n \n \n \n Webinar Description \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Build Trust and Deliver Compassionate Estate Planningfor Hispanic Families \n Hispanic families are one of the fastest-growing communities in the U.S.—but unique cultural values around family\, inheritance\, and faith can complicate traditional estate planning. This program will feature a discussion with Sonia Muñoz Gallagher\, Esq.\, and estate and special needs attorney in Florida\, exploring the intersection of estate planning and administration and cultural sensitivity when advising Hispanic families.  This session will highlight the growing need for estate planning among Hispanic clients and unpack key considerations such as multigenerational households\, bilingual communication challenges\, immigration and cross-border inheritance issues\, informal asset ownership\, and religious and community values that shape decision-making.  \n \n \n \n \n \n \n \n \n \n \n \n Amongst some clients there may be a cultural reluctance to discuss death. How can that be addressed? Catholic traditions are important to many Hispanic clients. This might affect donations to their church and broader charitable planning\, burial wishes\, and more. Caretaking expectations may rely more often on a parent’s daughters. What might that mean to planning?  \n Estate planning attorneys will gain practical tips for building trust\, navigating complex family structures\, and addressing legal misunderstandings with compassion and clarity. Don’t miss this opportunity to deepen your cultural competence and better serve a vital and expanding client base—register now to honor Hispanic heritage while enhancing your practice skills. \n \n \n \n \n \n \n \n View Recording\n \n This program will also acknowledge Hispanic Heritage Month which runs from 9/15-10/15 and is a national observance recognizing the histories\, cultures\, and contributions of Americans whose ancestors came from Spain\, Mexico\, the Caribbean\, and Central and South America. \n \n \n \n \n \n \n \n \n \n \n \n Our Speakers \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Martin M. SUMMARY:ILS Speaker Series: Estate Planning When Estate Taxes Don’t Matter
DESCRIPTION:View Recording\n \n \n \n \n \n \n \n \n \n \n Webinar Description \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n After years of speculation about what would happen with the estate (and gift) tax exemption\, we now have some clarity.  Things can always change\, but at the moment\, federal estate taxation has become irrelevant for most clients.  This means estate planning could fall off their radar.   \n Yet even without a tax component\, estate planning remains a necessary endeavor for any client who owns any type of property – both to permit the most efficient transfer of that property to the desired recipients at death and to plan for management in the event of incapacity. \n This webinar will consider what estate planners can recommend to potential clients of all levels of wealth who don’t need to plan for estate taxation\, but still need to plan: \n \n \n \n \n \n \n \n \n \n \n \n \n The bottom line – having an estate plan in place removes a huge burden after death\n An estate plan can protect assets from predators and creditors\n Clients with high – but not ultra-high – net worth should have a back-up plan in case the exemption drops\n State estate taxation still matters\, and a good estate plan can cover that too – even for clients who don’t currently reside in a decoupled state.\n \n \n \n As part of this discussion\, we will look at pros and cons of different approaches\, including leaving property outright or in trust\, and contingency plans: disclaimers\, Clayton QTIPs\, portability\, and more. \n \n \n \n \n \n \n \n \n \n \n \n InterActive Legal Speaker Series Presents \n \n \n \n \n \n \n \n \n \n \n \n \n Teresa L. In this webinar\, nationally recognized attorneys Jonathan Blattmachr\, Alan Gassman\, and Martin Shenkman break down the BBB’s 14 most impactful tax provisions\, explain their direct and indirect implications for estate planning\, and outline practical strategies you can implement right away. Whether your practice centers on traditional estate planning or sophisticated transfer tax work\, understanding the BBB’s sweeping changes is essential. Watch the full session below to stay ahead of the curve. \n \n \n \n \n \n Part 2: OBBBA’s New Rules Change Charitable Planning: Non-Grantor Trusts and Other Strategies to Maximize Benefits \n \n \n Discover how the One\, Big\, Beautiful Bill Act (OBBBA) is reshaping charitable planning. In this Hot Topic webinar\, leading estate planning attorneys Martin Shenkman\, Jonathan Blattmachr\, Alan Gassman\, and Robert Keebler break down OBBBA’s most impactful charitable provisions and share advanced strategies—like leveraging non-grantor trusts and CRTs—to maximize income tax benefits. Stay ahead of these sweeping changes with actionable insights you can implement now. \n \n \n \n \n \n Part 3: OBBBA’s New Rules Change Charitable Planning: Non-Grantor Trusts\,  Sec. 68(e)\, and Other Post-OBBBA Planning Considerations \n \n \n OBBBA made a myriad of changes to the tax law. The indirect planning implications are quite significant. This webinar assumes attendees are already familiar with the basic OBBBA changes and will build on that with a discussion of how and when non-grantor trusts may be used\, sometimes differently\, in planning post-OBBBA. In particular\, we will cover the repeal of Code Section 68(e) and the application of the new 2/37ths reduction in charitable contribution deductions to trusts. What impact will that change have on existing trusts that have charitable beneficiaries? How will charitable lead trusts be affected? What should trustees of such trusts consider? The use of non-grantor trusts to enhance charitable contribution deductions will still make sense for many taxpayers\, but practitioners should caution clients pursuing that planning of the implications of the new 2/37 reduction. For some clients using QCDs\, bunching\, or other planning techniques may be preferable.  \n \n \n \n \n \n Part 4: Basis Planning Post OBBBA \n \n \n With OBBBA’s new $15M exemption\, many clients will no longer face federal estate tax\, shifting the focus toward income tax basis planning. SUMMARY:Speaker Series Webinar - Charities and Retirement Plans: Friends or Foes?
DESCRIPTION:View Recording\n \n \n \n \n \n \n \n \n \n \n Webinar Description \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Charities can appear in a variety of places in living trusts\, such as recipients of pre-residuary bequests\, takers of a portion of a residuary bequest\, permissible appointees of powers of appointment\, or as “atom bomb clause” beneficiaries. They can also be named as remainder beneficiaries of conduit trusts\, “age 31” trusts\, special needs trusts\, standard accumulation trusts\, and testamentary charitable remainder trusts. This presentation will explore whether charities found in each of those places would be beneficial (a “friend”) or detrimental (a “foe”) to the tax advantages enjoyed by IRAs and other retirement plans. \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n InterActive Legal Speaker Series Presents \n \n \n \n \n \n \n \n \n \n \n \n \n Salvatore LaMendola \n \n View Recording\n \n \n \n \n \n \n \n \n \n \n Webinar Tips \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n After registering\, you will receive a confirmation email containing information about joining the webinar.\n Please note that space is limited in the live broadcast\, and we therefore recommend that you join early. SUMMARY:Speaker Series Webinar-Cutting the Cord: Tax Implications of Expatriation (Rescheduled)
DESCRIPTION:View Recording\n \n PLEASE NOTE:  If you were registered for this webinar when it was originally scheduled on August 6th\, you have been automatically registered for the rescheduled date of August 25th. \n \n \n \n \n \n \n \n \n \n \n \n Webinar Description \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Please join us for the next installment in the InterActive Legal Speaker Series on a topic that may be foreign to some of us – expatriation. Clients are becoming more interested in this topic\, and this presentation will focus on the tax implications in detail. \n In this webinar\, attorney Sebastian Orozco will provide a detailed examination of U.S. tax issues affecting individuals who expatriate under the framework of Section 877A of the Internal Revenue Code and the newly finalized Section 2801 regulations.  He’ll outline the definitions and criteria for classification as a covered expatriate\, and the resulting tax consequences\, including the mark-to-market exit tax regime\, the treatment of pre-expatriation gifting\, and beneficial interests in trusts.   \n \n \n \n \n \n \n \n \n \n \n \n We’ll learn about compliance requirements\, such as dual-status tax returns and Form 8854—including some of the penalties for non-compliance. Special attention will be given to the treatment of deferred compensation\, nongrantor trusts\, and tax-deferred accounts\, offering practical guidance for navigating the final year of U.S. tax residency. \n The materials also will explore strategic planning opportunities for long-term residents who are considering expatriation\, including treaty-based residency elections and pre-expatriation gifting strategies. The implications of the Section 2801 tax on covered gifts and bequests will be covered\, detailing how the tax is calculated\, reported\, and enforced. Examples will illustrate the tax treatment of distributions from domestic and foreign nongrantor trusts\, and the complexities that surround them. \n \n View Recording\n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n InterActive Legal Speaker Series Presents \n \n \n \n \n \n \n \n \n \n \n \n \n Sebastian Orozco Segrera \n \n \n \n \n \n \n \n \n \n \n \n Webinar Tips \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n After registering\, you will receive a confirmation email containing information about joining the webinar.\n Please note that space is limited in the live broadcast\, and we therefore recommend that you join early. As a result\, income tax planning\, and in particular maximizing income tax basis\, may be a focus of increased attention\, which triggers several questions: \n \n \n • In addition to upstream planning with GPOAs\, what about downstream planning with gifts?• How do we reconcile that basis step up planning may conflict with traditional planning strategies of keeping assets in trust for a surviving spouse and others?• What can be done with existing credit shelter trusts\, SLATs\, and other irrevocable trusts that are outside of anyone’s gross estate?• Can – and should – existing estate tax plans be unraveled?• How can powers of appointment be effectively used to increase options for basis step up?• Can upstream as well as downstream planning be used?• How will gift planning be different\, after OBBBA? \n \n \n \n \n \n \n \n \n \n \n \n Join us for an online webinar to consider these questions and the post-OBBBA planning shift. \n \n View Recording\n \n \n \n \n \n \n \n \n \n \n \n Meet Our Speakers \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Jonathan G. \n \n \n \n \n View OBBBA Webinar Series\n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Webinar Tips \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n After registering\, you will receive a confirmation email containing information about joining the webinar.\n Please note that space is limited in the live broadcast\, and we therefore recommend that you join early. DESCRIPTION:Complimentary Webinar: Basis Planning After OBBBA\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n\n\n\n	\n \n \n \n View Recording\n \n \n \n \n \n \n \n \n \n \n Webinar Description \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n In a recent Delaware asset protection case\, In Re CES 2007 Trust\, a self-settled domestic asset protection trust (DAPT) was upheld. The settlor had some foot faults in the administration of the trust and the trust owned other entities\, but neither of those facts were fatal to the positive result. The court upheld the DAPT even though the settlor served as the trust’s investment advisor and as manager of real estate LLCs owned by the trust. This program will review the recent Delaware case and evaluate its import to asset protection planning generally.  The speakers will analyze the facts in the case and make specific recommendations to practitioners as to how to implement similar plans in the future. \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n View Recording\n \n \n \n \n \n \n \n \n \n \n Meet Our Speakers \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Jonathan G. DESCRIPTION:Due to unforeseen circumstances\, “Cutting the Cord:  Tax Implications of Expatriation” is being postponed to a later date. We apologize for any inconvenience this may cause\, and hope to see you at the rescheduled event. \n\n\n\n \n\n\n\n\n\n\n\n\n\n\n\n\n\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n\n\n\n	\n \n \n \n \n Webinar Description \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n Please join us for the next installment in the InterActive Legal Speaker Series on a topic that may be foreign to some of us – expatriation. \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n InterActive Legal Speaker Series Presents \n \n \n \n \n \n \n \n \n \n \n \n \n Sebastian Orozco Segrera \n \n \n \n \n \n \n \n \n \n \n \n Webinar Tips \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n After registering\, you will receive a confirmation email containing information about joining the webinar.\n Please note that space is limited in the live broadcast\, and we therefore recommend that you join early.
