Practitioners may want to change documents they draft today! \n						The implications for transfer tax planning\, trust drafting\, and client advisory strategies will be discussed. The program provides a technical yet practical analysis of how reduced estate\, gift\, and portability thresholds\, higher marginal rates could reshape planning conversations for a far broader client base than in recent years. \n					\n				\n				\n					\n				\n			\n		\n		\n			\n				\n					\n						Drawing on current legislative proposals and emerging state‑level tax trends\, the webinar explores how traditional approaches—such as portability‑only planning\, formula clauses\, and high‑exemption drafting defaults—may require reassessment. The settlor had some foot faults in the administration of the trust and the trust owned other entities\, but neither of those facts were fatal to the positive result. The court upheld the DAPT even though the settlor served as the trust’s investment advisor and as manager of real estate LLCs owned by the trust. DESCRIPTION:Complimentary Webinar: Well-Being Trusts: Beyond Distribution Standards\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n	\n\n\n\n	\n		\n			\n				\n			\n		\n		\n			\n				\n					\n						Webinar Description \n					\n				\n			\n		\n		\n			\n				\n					\n						\n					\n				\n			\n		\n		\n			\n				\n					\n						While trusts have always been created to protect beneficiaries\, more can be done to help beneficiaries benefit from the wealth that is bequeathed not actually “to” them\, but for them.  So-called “Well-Being Trusts” are consistent with a growing trend to be more inclusive of what can – and perhaps should – be provided for beneficiaries of trusts\, beyond just making distributions.   \n						Delaware\, as it often does\, has lead the charge on this new approach to trust drafting and administration by enacting a new Well-Being Trust statue.  It is an “opt in” provision that drafters can incorporate into new trust documents and include in existing trusts via decanting or non-judicial modification.  In this webinar\, the speakers will discuss the Delaware Well-Being Trust statute and the various issues it raises (not the least of which is potential trustee liability).  Other important issues include: \n					\n				\n				\n					\n				\n			\n		\n		\n			\n				\n					\n						\n							Income tax considerations\, such as whether payment for programs for beneficiaries qualifies as a trust administrative expense or carries out DNI\n							Using a letter of wishes\n							Custom provisions practitioners might include\n							Conflicts that could arise in some situations\, such as if a beneficiary is addicted to drugs\n							The need for mechanisms to change trustees and/or the terms of the trust.\n							Please note that space is limited in the live broadcast\, and we therefore recommend that you join early.
